Terms of service

Thank you for trusting and using ESC's services. Please read the following agreement carefully before you start using our services.

Article 1: Overview

Scope of application: This agreement applies to all matters related to the registration and use of services available on or originating from the website www.esc.vn between the service user and the service provider, Online Solutions Company Limited (ESC).

Your use of the website www.esc.vn and the services available on this website implies that you have agreed to the contents specified in this Terms of Service agreement.

Definitions:

– “ESC”, “We”, “Party B”: Online Solutions Company Limited.

– “You”, “Subject”, “Party A”, “Service User”, “Valued Customer”, “Customer”: The person using this website or the person purchasing and using the services on this website.

– “Domain”/”.vn Domain Name” is the country code top-level domain (ccTLD) of Vietnam managed by the Vietnam Internet Network Information Center – Ministry of Information and Communications (VNNIC). The “.vn” domain name includes non-diacritic domain names and Vietnamese diacritic domain names.

– “Domain”/”International Domain Name” refers to domain names at all levels under the generic top-level domains (gTLD) such as “.com”, “.net”, “.edu”, “.org”, “.int”, “.biz”, “.info”, “.name”, “.pro”, etc., and domain names at all levels under country code top-level domains (ccTLD) other than Vietnam's country code domain name.

– ICANN (Internet Corporation for Assigned Names and Numbers): The international organization that manages domain names and numbers, with authority over the global top-level domain name system.

– VNNIC (Vietnam Internet Network Information Center): An agency under the Ministry of Information and Communications, performing the function of managing and promoting the use of Internet resources in Vietnam; establishing, managing, and operating the National DNS System and the National Internet Exchange (VNIX).

– “Hosting” or “Web hosting” is the storage space subdivided from a server that helps you upload data, publish websites, or applications on the internet. When using a hosting system, you place the necessary data files on the provider's server for your website or online application to run.

– “Email”, “Mail”: Short for “Electronic Mail”, used to send or receive content and exchange information on the internet.

– “NameServer”, “DNS”: The domain name resolution system on the Internet. Simply put, DNS is a system that converts easy-to-remember domain names (e.g., www.esc.com) into very difficult-to-remember IP addresses (e.g., 210.211.108.157).

– “Email Admin”, “Registrant Email”: The email address used for verification when registering international domain names. As required by ICANN, international domain names must be verified from the registrant's email address upon registration or when information is modified.

– “Admin”: Short for “Administrator”, meaning the manager or supervisor. This is the highest privilege level for a user within storage systems or system administration.

– “Download”: The process of transferring data from the internet to a computer.

– “File”: A collection of data that is named and stored on storage devices such as hard drives, floppy disks, USBs, CDs, DVDs, etc.

– “License Key”: A copyrighted software code or key provided by the official software manufacturer. During installation or usage, if not yet activated, the software will require you to perform activation to continue using it.

– “Control Panel”: A tool that allows users to manage systems through an intuitive visual interface, such as Cloud Hosting, Cloud Server, Email, DNS, ID, etc.

Based on business practices and legal regulations, we reserve the right to adjust, update, supplement, or remove part or all of the terms of this service agreement without being required to notify you directly, but we will publish it openly on our website.

You agree that if you continue to access our website and/or use ESC's services after the use agreement is updated or supplemented, it means you have accepted and agreed to comply with the updated terms. You should regularly review the service agreement whenever you access the website, and you can view the latest version at any time at https://esc.vn/thoa-thuan-su-dung

Article 2: Rights and Responsibilities of the Customer (Party A)

1. If the Customer registers/renews a Domain Name (Domain)

The Customer is responsible for checking and ensuring that the domain name has been registered or renewed on INTERNIC whois.net.vn and/or other whois systems after registering or renewing the domain name.

The Customer is responsible for submitting the domain registration application and complying with the regulations on managing and using Internet resources issued by the Vietnam Internet Network Information Center (VNNIC) – Ministry of Information and Communications.

Complete the registrar transfer documents according to the regulations of the Registrar. The Customer must agree that during the domain transfer process, whois information and NameServers cannot be changed.

Before executing a transfer command to ESC, the domain subject should note the following actions:

– Change the domain NameServer to ESC before transferring, or immediately after the transfer is completed if the name server is still at the old registrar.

– Unlock the domain and provide the domain's Authentication code.

If the Customer registers an international domain name, the Customer is responsible for declaring the international domain name information on the website www.thongbaotenmien.vn.

The Customer is responsible for securing the login credentials to the domain management system and bears all legal responsibilities for any unlawful actions arising from the use of the domain name.

2. If the Customer registers a Website Hosting Service (Hosting)

The Customer has the right to manage and is responsible for securing the login credentials to the system and access information of the registered service, and bears all legal responsibilities for any unlawful acts arising from the use of this service.

Unacceptable forms of use:

– Using the Web Hosting service as a storage support or bandwidth/traffic sharing location for another website.

– Continuously creating and deleting a large number of files, affecting the storage system on the server.

– Re-sharing the service package to a third party (applicable to Web Hosting service packages using multiple domain names, meaning that the service is provided to a single customer who owns multiple domain names and websites belonging to that customer or their business).

– Websites continuously sending/receiving a large volume of requests, causing network congestion and affecting server performance.

3. If the Customer registers an Email Service

The Customer has the right to manage and is responsible for securing the login credentials to the system and access information of the registered service, and bears all legal responsibilities for any unlawful acts arising from the use of this service.

The Customer shall not use the email service hosted at ESC to send spam, promotional emails, bulk mail, mass mail, bomb mail, phishing mail, etc. We reserve the right to temporarily suspend or terminate the service without refund depending on the severity and impact of the violation. We do not tolerate any form of Spam Email, even if the action is accidental due to your Email service being exploited or controlled by a virus.

The Customer is responsible for controlling outbound Email delivery on their Email accounts. You will be solely responsible for all consequences caused by spam, promotional emails, bulk mail, mass mail, bomb mail, phishing mail, etc., which lead to the IP address being blacklisted by anti-spam organizations.

For Email Servers, upon detecting cases of spam, promotional emails, bulk mail, mass mail, bomb mail, phishing mail, etc., ESC's technical team will temporarily freeze the account or suspend the service. You must ensure that you have resolved the issues yourself, such as: clearing viruses, malware, infected files, phishing links, and handling spam emails on your system before requesting the service to be reactivated.

Proactive data backup: We always respect your personal Email data, which means you always have the right to proactively back up your Email data. We will not intervene under any circumstances to retrieve lost emails or recover emails lost during your use of rules, filters of third-party software such as Outlook, Thunderbird, Windows Live Mail, etc., or due to email deletion, for any accidental or intentional reason.

4. If the Customer uses a Dedicated Server or Virtual Private Server (VPS) service

The Customer has the right to operate and manage the server, and is responsible for backing up and restoring server data. The Customer is responsible for managing the content of information on the server, ensuring that this information does not violate legal regulations.

Comply with and take responsibility under national and international regulations regarding Internet service usage, state secrets, security, culture, industrial property rights, operating system copyrights, and software installed on the server (if any).

5. If the Customer uses a Server Colocation Service (Colocation)

The Customer has the right to operate and manage the server, and is responsible for backing up and restoring server data, as well as hardware maintenance and troubleshooting. The Customer is responsible for managing the content of information on the server, ensuring that this information does not violate legal regulations.

Comply with and take responsibility under national and international regulations regarding Internet service usage, state secrets, security, culture, industrial property rights, operating system copyrights, and software installed on the server (if any).

6. If the Customer uses the .VN Domain Locking Service

Party A transfers all domain names registered under this service to Party B for management and changes the NameServers of these domain names to use the NameServers provided by Party B.

Party A is not allowed to transfer the domain name to another registrar before the contract expires.

Provide information about the person authorized to make decisions regarding these domain names according to Appendix 1 attached to this contract, based on the information in the domain registration application.

Article 3: Rights and Responsibilities of ESC (Party B)

1. If the Customer (Party A) registers/renews a Domain Name (Domain)

Party B provides Party A with the account information (username, password) of the domain name after Party A registers.

All dispute issues related to Vietnam domain names under this contract will be handled by Party B based on the regulations of the Vietnam Internet Network Information Center (VNNIC). All dispute issues related to international domain names under this contract will be handled by Party B based on the regulations of the top-level domain management organization (ICANN). Party B bears no liability in this regard.

During the time of contract signing and payment processing, if the domain name is registered by another entity, Party B is completely held blameless. In the event that the domain name has been registered by another owner who is not Party A, or cannot be renewed, Party B is responsible for refunding the registration or renewal fee of that domain name to Party A.

2. If the Customer uses a Website Hosting or Email Server service

Party B provides Party A with the account information (username, password) of the web hosting/Email server after Party A registers.

Party B does not assume any legal liability or compensation for damages related to the services provided by Party B, nor does it assume any responsibility or compensation for the loss of Party A's data.

3. If the Customer uses a Dedicated Server or Virtual Private Server (VPS) service

Party B will replace faulty hardware free of charge during the usage period within 48 hours if the hardware provided by Party B encounters an error.

Party B does not assume any legal liability or compensation for damages related to the services provided by Party B, nor does it assume any responsibility or compensation for the loss of Party A's data.

Party B is not responsible for operating system copyrights and unauthorized software used by Party A on the server.

4. If the Customer uses a Server Colocation Service (Colocation)

Party B does not assume any legal liability or compensation for damages related to the services provided by Party B, nor does it assume any responsibility or compensation for the loss of data or damage to Party A's equipment.

Party B is not responsible for operating system copyrights and unauthorized software used by Party A on the server.

When Party A officially terminates the Contract in writing and completes the payment of all incurred fees, Party B will return Party A's server or equipment hosted at Party B's data center to Party A.

5. If the Customer uses the .VN Domain Locking Service

Party B will register this service with VNNIC. After Party A's domain name is successfully protected, the status displayed upon a whois lookup will be:

6. If the Customer uses Software or License services

Party B retains full authority to modify policies regarding software and licenses (if any) when the software provider introduces changes.

Article 4: Regulations on Domain Name Usage

Domain names are a special resource allocated on a first-come, first-served basis. ESC provides domain name registration services to customers within the scope that the domain name has not been registered by another entity at the time of registration and completion of payment, subject to the approval and licensing of the domain name management authority.

In the event that the domain name cannot be registered because it is already owned by another individual or entity, ESC will refund 100% of the domain registration fee to you.

The Customer acknowledges and agrees that domain name registration services are non-refundable once registration or renewal has been executed, or if the Customer unilaterally terminates the use of the service.

Once registration is complete, the Customer cannot modify: (a) the spelling of the domain name, or (b) the registrant's name for a .VN domain name, except in specific cases regulated by VNNIC.

Domain names that have expired without maintenance fee payments will be canceled and made available to other applicants. ESC no longer holds management rights or responsibilities for domain owners who do not continue to renew their usage.

The Customer must proactively monitor the domain expiration date and perform renewal before it expires. ESC is not responsible for any suspension or loss of domain names due to the owner's failure to pay renewal fees or late payments.

As the owner of the domain name, the Customer must manage it independently and take sole responsibility for its usage. ESC disclaims all responsibility if the Customer uses the domain name to engage in unlawful activities.

All dispute issues related to .VN domain names will be handled by us based on the regulations of the Vietnam Internet Network Information Center (VNNIC). All dispute issues related to international domain names will be handled based on the regulations of the top-level domain management organization (ICANN).

The domain subject must comply with the regulations of the Registrars, Registries, VNNIC, and ICANN.

The domain name registration certificate carries no legal weight in determining domain ownership when a dispute occurs.

Article 5: Information Privacy Policy

At ESC, we respect your privacy, and that is why we are always committed to protecting your personal information. In this document, the concept of "personal information" is understood to include your name, address, email address, telephone number, or any other personal data you provide, or any information about you collected in accordance with applicable laws. We hope this document helps you clearly understand what personal information we collect and how we subsequently use it.

When you access and use the website (including online service registration), we understand that you fully agree to the terms of this policy.

1. Declaration Upon Use

All content you view on the website is intended to serve your informational needs and help you choose services. Therefore, you may use the website without providing any personal information. However, in certain cases related to service registration, we may request that you provide personal information.

2. Personal Information Provided by You

When you provide the necessary information, we will use it to fulfill your requests, or we may contact you via mail, email, text message, or telephone; or, in accordance with applicable laws, use these means to introduce you to new products, services, or promotional programs from ESC. By providing information to us through this website, you clearly understand and consent to the collection, use, and disclosure of the aforementioned personal information for the purposes specified on this page.

You fully agree and accept that the personal information you provide when using the website may be retained at ESC's headquarters or branches, and may be stored on existing or yet-to-be-disclosed servers for the purpose of operating and developing the website as well as ESC's services.

If you order a product, request a service, or submit feedback to the website, we may contact you for additional information necessary to process or complete your order and/or request. However, we will not provide this information to a third party without your permission, except where required by applicable law or when necessary to process the order (for example: registering with VNNIC, resolving disputes).

ESC commits to protecting your privacy and does not sell or trade your personal information to other companies for promotional purposes.

3. Provision to Other Entities

ESC may utilize other entities to provide products or services to you. We may also need to share your personal information with these entities so they can complete your request. These entities are not permitted to use your personal information for other purposes, and we simultaneously require them to comply with confidentiality regulations when providing services.

ESC is not permitted to allow third parties to access, retrieve, or perform any operation directly or indirectly on the servers providing the service or on customer servers, except upon request from competent authorities in accordance with Vietnamese law.

4. Recording Browser Information

Occasionally, information may be placed on your computer to help us upgrade the website or improve the quality of our service to you. This information is commonly known as "cookies," which many websites currently use. "Cookies" are pieces of information stored on your computer's hard drive or browser, not on the website. They allow the collection of certain data about your computer, such as your IP address, operating system, browser type, and the addresses of related websites.

If you do not wish to receive these cookies or want to be notified when they are placed, you can set your browser to do so if your browser supports it. Please note that if you turn off cookies, you will not be able to access or use certain features on the website that require identification. We do not intentionally restrict your use in this situation; it is merely a limitation in the programming and construction of the website.

5. Security

When programming the website, we establish commercially reasonable rules to prevent unauthorized access and inappropriate use of your personal information submitted to ESC through this website. Since there are always risks associated with providing personal data—whether directly, by phone, over the internet, or through other technical means—and no technical system is absolutely secure or entirely proof against all "hackers" and "tampers" (unauthorized persons who breach systems to rummage for data), ESC makes continuous efforts to implement appropriate precautionary measures tailored to the nature of the information to prevent and minimize risks when you use this website.

6. Information via Email

When you register for services, the email address you provide will be used as a tool to exchange information with you. First and foremost, please ensure that you provide an email address that remains functional for you throughout your use of the service.

We may send confidential information or receive your support requests via email. In the event that you no longer use the provided email address, you must notify us of this change.

To protect you, ESC may temporarily suspend accepting requests via your provided email address if we detect fraud or unusual information—until we can contact you for confirmation.

7. Adjusting Collected Information

ESC will proactively or at your request supplement, correct, or erase inaccurate, incomplete, or outdated personal data while you remain associated with our activities.

8. "Minors" Subject

ESC reserves the right to refuse service to individuals who are minors (as defined by the local laws where you reside). Minors are not entitled to purchase or attempt to use services under other legal provisions on this website without the consent of a parent or legal guardian, unless local law applies or permits otherwise.

9. External Links

This website may contain links to other websites placed for introductory purposes or to provide supplementary information for your reference. ESC is not responsible for the content or practices of any other website.

10. Payment Information Security Policy

a. Commitment to Information Security:

The payment system via Card/E-wallet deployed on ESC's website is provided by partners legally licensed to operate in Vietnam within the field of payment gateways. Accordingly, security standards applied when Customers make payments via Card or E-wallet at ESC always ensure compliance with the Security and Safety standards regulated in the banking and finance sector.

b. Security Regulations:

Payment transactions using International Cards, Domestic Cards (internet banking), and E-wallets comply with the security standards of the payment gateway providers, including:

– All Customer information will be protected throughout the transaction process using the SSL (Secure Sockets Layer) protocol.

– Encryption standards up to 128-bit.

– Compliance with principles and regulations on information security in the banking and finance sector as specified by the State Bank of Vietnam.

Online payment information privacy policy applied by ESC to Customers: ESC only stores the Token string encrypted by the payment gateway providers when Customers perform online payments (Direct payment, Pay Token, or Auto-renewal) on ESC's website system. ESC will not directly store information related to the customer's card data on its system. The security of the customer's payment card information is handled entirely by the payment gateway providers.
