On June 8, 2016, at the headquarters of the Ministry of Information and Communications – 18 Nguyen Du – Hanoi, the Ministry of Information and Communications and the Ministry of Science and Technology coordinated to organize a ceremony to sign and issue Joint Circular No. 14/2016/TTLT-BTTTT-BKHCN dated June 8, 2016, guiding the order and procedures for changing and revoking domain names infringing on intellectual property laws. Joint Circular No. 14/2016/TTLT-BTTTT-BKHCN of the Ministry of Information and Communications and the Ministry of Science and Technology was developed based on the tasks assigned by the Government to both Ministries in Decree No. 99/2013/ND-CP. The joint circular consists of 4 chapters and 16 articles, applicable to organizations and individuals registering and using ".vn" domain names, agencies, organizations, and individuals related to the use of ".vn" domain names; agencies competent to handle administrative violations in the field of intellectual property; persons competent to sanction administrative violations of intellectual property in accordance with the law and domain name management agencies; and ".vn" domain name registrars. Circular Guiding the Transfer of Usage Rights for Internet Domain Names Allocated Without Auction
On June 28, 2016, the Ministry of Information and Communications issued Circular No. 16/2016/TT-BTTTT providing guidance on the usage rights of Internet domain names allocated without auction. This Circular takes effect on August 15, 2016. However, specific guidelines regarding the transfer tax payment process—a mandatory condition that transferring parties must complete prior to transferring domain name usage rights—have not yet been fully aligned with the Circular. Consequently, the Ministry of Finance will soon issue timely guidelines on taxes and payment methods for the transfer of domain name usage rights to match the effective date of the Circular, ensuring compliance with legal procedures for all parties involved in the transfer.
